Deltorin SafeCrew Terms of Service
App update availability: The new reporting, hiding, blocking and on-phone cleanup controls described here require the forthcoming SafeCrew app update. They are not yet available in earlier installed versions. Existing account-deletion and server-cleanup changes are already live.
Version: 1.3 (objectionable content, reporting, hiding and blocking) Effective date: October 11, 2026
These Terms are an agreement between you and AY6 Safety LLC ("AY6", "we", "us") for using the Deltorin SafeCrew mobile app. By creating an account or using the app, you agree to these Terms. If you accept them for a company, you confirm that you are authorized to do so.
1. What Deltorin SafeCrew does
Deltorin SafeCrew helps crews create, sign, store and share workplace safety records: job briefings, job hazard analyses, emergency action plans, incident reports, observations, toolbox talks and corrective actions.
2. What Deltorin SafeCrew does not do
The app does not make work safe. People do.
Deltorin SafeCrew is a recordkeeping tool. It is not:
- a qualified person, a supervisor or your employer's safety program;
- an official interpretation of OSHA or any other regulation;
- legal advice or an engineering decision;
- a guarantee that you comply with any law;
- an alarm, warning system or monitoring device.
Nothing in the app authorizes anyone to start or continue work. Every safety decision belongs to the qualified people on site, following your employer's program and the law.
If the app is down, a record will not sync, or information in it is wrong, follow your employer's safety program anyway. An outage is never a reason to skip a briefing or work unsafely. Keep a way to work without the app.
Reference information in the app can be out of date. Check it against current regulations, your employer's procedures, site and client requirements, and manufacturer instructions.
3. Your account
- Give accurate information and keep your sign-in details private.
- You must be at least 18 years old to create an account or use the service.
- You are responsible for what happens under your account.
- Your company's owners decide who has access and at what level. They can remove your access.
- Safety records belong to your company's safety program. Leaving the company or deleting your account does not delete them (see the Privacy Policy, section 8).
4. Reviewing and signing records
- Review a document, including its attachments, before you submit, finalize, export or rely on it. Review it again after any important change.
- Sign only for yourself. Never sign for someone else or say an absent person took part.
- An authorized crew member may prepare and finalize a Job Briefing without a supervisor title. Finalizing records that the review step was completed. It does not certify that the site is safe, and it does not replace anyone's own signature.
- A draft PDF is for review. Creating or sharing it does not mean anyone reviewed, signed or approved it.
- If conditions change, follow your employer's procedures, tell the person in charge, and stop work when those procedures or the law require it.
5. Acceptable use
You agree not to:
- falsify a record, signature, date or attribution;
- upload content you do not have the right to share;
- try to get around access controls or reach another company's data;
- reverse engineer, overload or interfere with the service;
- upload images of injuries, medical information or other sensitive personal content unless your company has specifically allowed it;
- use the app for purposes unrelated to workplace safety.
The app records who did what and when, and it locks finalized records. It cannot prove that the facts someone enters are true.
Objectionable content, reporting, hiding and blocking
Do not post harassing, threatening, sexually explicit or hateful content.
The filter, reporting, hiding and blocking described below come with the app update released with this version of the Terms. Earlier app versions do not have them, and once our updated access rules take effect they can no longer post comments. Update the app to keep commenting.
- Filter. Follow-up comments containing common profanity, sexual or harassing terms cannot be posted. Our server checks each comment from the current app before saving it, and comments typed offline are checked when they are sent. Nothing is sent to an outside screening service. The filter uses a word list, so it cannot catch every offensive comment. It does not apply to incident or observation descriptions, witness statements or other safety details, because a filter could change what a witness reported.
- Report. You can report another member's comment, photo or record. Your company's owners and safety managers review reports and can see who filed them. If the report is about one of them, AY6 Safety LLC reviews it too. The person you report cannot see your report. We do not promise a review time.
- Hide or block. You can hide a single comment or photo, or block a person so their comments and the photos they upload are collapsed for you. A blocked person also can no longer comment on or attach photos to records you created, unless they are assigned to or verifying that work. Blocking does not delete anything, does not remove that person's access to records, and never hides safety details in a record, such as descriptions, hazards, signatures or assignments. Older photos that do not record who uploaded them are not collapsed by a block, but you can hide them one at a time.
- Removing someone from your company. Only your company's owners and safety managers can do this, by deactivating the member. Their records are kept.
6. Plans and payment
- Starter is free. Pro is a subscription sold in the app through the Apple App Store or Google Play. Business and Enterprise are sold directly under a separate written agreement.
- Pro is billed by Apple or Google. The Subscription Terms explain pricing, renewal and cancellation.
- A subscription does not include our separate safety consulting services.
Always free
These are free on every plan and are never limited by credits, quotas or subscription status:
- Stop Work Authority, and recording why work stopped
- Emergency information, such as contacts, muster points and AED locations
- Reporting hazards, near misses and incidents
- Signing a document you were briefed on
- Deleting your account
7. Your content
You and your company keep whatever rights you have in the content you add. You give us permission to store, process, back up and display that content only to provide and secure the service and to meet our legal obligations, as described in the Privacy Policy. We do not use your content to train AI models.
8. Optional Safety Assistant
The optional Safety Assistant sends your question and earlier messages in the chat to Anthropic only after you accept the separate provider notice. General acceptance of these Terms does not authorize that processing. Before every question, follow-up or retry, you must separately acknowledge that you will check the answer against actual job conditions and applicable requirements.
Answers can be wrong or out of date. They are reference drafts, not official OSHA interpretations, legal advice, engineering approvals or certified safety or compliance determinations. Check them with a qualified person before you act. Do not include medical details or other information you do not want shared with the provider.
You can withdraw provider permission on the Safety Assistant screen. Withdrawal stops future authorized requests after it is successfully saved; it does not recall content already sent. The Privacy Policy explains provider processing and retention. Provider-backed speech recognition and user-facing AI document drafting are not available in this version.
9. Availability and changes to the service
We work to keep the service reliable but do not promise it will always be available. The app works offline for records already on your device. It cannot open a record it has never downloaded.
We may change or remove features. If we shut down the service, we will give reasonable notice and a way to export your company's records.
10. Warranty disclaimer and limits on liability
To the extent the law allows, the service is provided "as is," without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement.
To the extent the law allows, AY6 is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption arising from use of the service. AY6's total aggregate liability for claims arising out of or relating to these Terms or the service is limited to the greater of $100 or the fees you paid AY6 for the service, including through an app store, during the 12 months before the event giving rise to the claim. The $100 minimum also applies to free users.
Nothing in these Terms limits liability that the law does not allow us to limit, including liability for death or personal injury caused by negligence, or for fraud.
11. Business-customer indemnity
If you accept these Terms on behalf of a business, that business agrees to cover third-party claims to the extent they are caused by its unlawful use of the service, a material breach of these Terms, or content it uploads that infringes someone else's rights. This does not cover claims caused by AY6's own breach, negligence or willful misconduct, and it does not apply to an individual worker just because they use a company account.
12. Governing law and disputes
These Terms and disputes arising out of or relating to these Terms or the service are governed by Florida law, without regard to its conflict-of-laws rules, except where applicable law requires otherwise.
To the extent permitted by applicable law, you and AY6 agree that lawsuits arising out of or relating to these Terms or the service will be brought exclusively in the state courts located in Hillsborough County, Florida, or, if federal subject-matter jurisdiction exists, in the United States District Court for the Middle District of Florida, Tampa Division. You and AY6 consent to personal jurisdiction in those courts for these disputes.
Nothing in this section limits rights or protections that cannot be waived under applicable law, including any mandatory consumer protections or right to bring a claim in another court where applicable law requires that right.
These Terms do not require arbitration and do not include a class-action waiver.
13. Ending your use
You can stop using the app at any time and delete your account inside the app. We may suspend or end access for a serious breach of these Terms. Company safety records may remain after an individual account ends.
14. App store terms
If you downloaded the app from the Apple App Store, these Terms are between you and AY6, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation for the app. Apple is not responsible for addressing claims about the app, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm that you are not in a country subject to a U.S. government embargo and are not on a U.S. government list of prohibited or restricted parties. Apple's standard End User License Agreement governs the license to the iOS app. These Terms govern the Deltorin SafeCrew service and supplement that license where applicable; they are not a custom Apple EULA.
If you downloaded the app from Google Play, Google Play's terms also apply to your use of the store.
15. Changes to these Terms
When we update these Terms, the version number above changes and the app records which version you accepted. We will tell you about important changes in the app before they take effect.
